Tried Twice for One Punch
United States v. Lara (2004)
Charge: Assaulting a federal officerCourt: U.S. Supreme CourtState: North DakotaDocket: The Domestic Dependent Nation
The facts
A man is an enrolled member of one tribe but married into another and lived on its reservation. That second tribe ordered him to stay off its land. He ignored the order. When federal officers came to arrest him, he struck one of them. The tribe's own court dealt with him first: he pleaded guilty there to violence against a policeman and served ninety days. Federal prosecutors then charged him over the same punch. He says two trials are not allowed.
