Can an importer be punished here for breaking a foreign fishing rule that the foreign country later declared invalid?
The facts
A cargo ship brought tons of frozen lobster tails from Central America into an Alabama port. An anonymous fax tipped off inspectors. Much of the catch was under the legal length, some carried eggs, and it came in bulk plastic bags, not the boxes the exporting country required. The Defendant had told his captains never to take undersized or egg-bearing lobster. That country's courts later declared the size rule void.
