The facts

A naval intelligence analyst held a top secret clearance. He also did paid work on the side for a foreign defence magazine. He took three classified satellite photographs showing a rival power's aircraft carrier under construction, cut the secret markings off them, and posted them to the magazine's editor abroad. They were published. He is charged with passing national defence information to someone not entitled to receive it, and with stealing government property. He says the free-press guarantee protects him.
