The Pistol Under The Bar

United States v. Panter (1982)

Charge: Possession of a firearm by a convicted felonCourt: U.S. Court of Appeals for the Fifth CircuitState: MississippiDocket: No Choice

The facts

A man with an old felony conviction was tending bar when a customer went for him. The customer, who had himself been convicted of murder, stabbed him in the stomach. He reached under the bar for a club and came up with a pistol instead. He fired three shots and the attacker died the next day. He put the gun on the bar at once. Federal law bans a felon from possessing a gun and says nothing about why he held it.

You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
