The Captured Sergeant
United States v. Provoo (1954)
Charge: Treason (collaborating while a prisoner of war)Court: U.S. Court of Appeals, 2d Cir.State: New YorkDocket: Treason
The facts
An Army staff sergeant was captured by the enemy early in the war. Prosecutors say that as a prisoner he offered his services to his captors, reported an American captain as hostile to them so that the captain was put to death, and made two radio broadcasts for the enemy. At trial the prosecutor questioned him about unrelated suspicions of homosexuality. He argues this questioning unfairly turned the jury against him, and that he was tried in the wrong place.
