The facts

A television pitchman had earlier settled a case with a consumer regulator by agreeing to a court order. That order barred him from misrepresenting the contents of his books in television infomercials. He then wrote a diet book and sold it on television, telling viewers the plan was simple and inexpensive, with no food restrictions and no exercise. The book in fact called for prescription hormone injections and a strict diet. He was prosecuted for disobeying the order.
