United States v. Tucker (2021)
Charge: Conspiracy to distribute heroin - selling drugs from a Washington, D.C. barbershopCourt: U.S. Court of Appeals for the District of Columbia Circuit (appeal from D.D.C.)Docket: Close Shaves
Was the man selling from the barbershop a member of the drug conspiracy run upstairs?
The facts
Federal agents spent months investigating drug dealing at Next Level Cuts, a barbershop in Southeast Washington, D.C. When they searched a suite above the shop they found cash, guns, heroin mixed with fentanyl, PCP and other drugs. A drug dealer who became a government witness testified that one man ran the operation from the upstairs suite, a second controlled who got in, and a third, Lonnell Tucker, sold drugs from the barbershop. Agents had bought 0.58 grams of heroin from Tucker in one controlled sale, and they pointed to his coded text messages and his constant presence at the shop. Tucker said he was not part of anyone's conspiracy.
