The Secret Formula Sale

United States v. Williams (2008)

Charge: Conspiracy to commit theft of trade secrets (18 U.S.C. 1832)Court: U.S. Court of Appeals, 11th Cir. (on appeal from N.D. Ga.)State: GeorgiaDocket: Stolen Secrets

The facts

An executive assistant at a large drinks company obtained confidential company documents and a sample of a product that had not yet been launched. Prosecutors said she recruited an acquaintance to help sell them, and a third man then negotiated the sale. The buyer he was dealing with was in fact an undercover agent. One of her helpers pleaded guilty and testified against her. She denied the charge and went to trial. The law requires proof of an agreement to steal information the company kept secret.

You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
