The facts
Years after a man was convicted of murder and sentenced to death, he asked the state courts to reopen the case. He said the prosecution had buried evidence that helped him and had put on false testimony. A lower judge agreed and blocked the execution, but the state's highest court reversed that. One of the judges who sat on that appeal had, years earlier, been the elected prosecutor who personally signed off on seeking death against this same man. The defendant said that judge should have stepped aside.
